As a mediator, Mark uses an analytical and evaluative approach, while looking for common interests and creative solutions. 

Mark Hart has over 20 years of experience as a mediator, adjudicator and investigator, with a focus on human rights, employment and labour issues.

 

Most recently, Mark was a Vice-Chair at the Human Rights Tribunal of Ontario for 12 years from 2007 to 2019, where he conducted hundreds of mediations and hearings primarily in the employment and labour sectors. He has written hundreds of decisions, including leading decisions on a variety of human rights, employment and labour issues.

 

As a mediator, Mark uses an analytical and evaluative approach, while looking for common interests and creative solutions. He was one of the most effective mediators at the Tribunal, with an early mediation resolution rate of close to 80%, well above the Tribunal average, and a mediation / adjudication settlement rate of 95%. He is highly skilled in resolving complex and difficult cases, cases involving multiple parties, and cases where the parties have an ongoing relationship.

 

As an adjudicator, Mark has been a pioneer in developing and employing active adjudication techniques to shorten hearings, save costs and achieve timely outcomes, while promoting and preserving fairness for all parties. He handled some of the most complex and challenging cases at the Tribunal in a timely and effective manner.

 

Prior to joining the Tribunal, Mark had a practice that included conducting internal human rights and workplace violence investigations for a broad spectrum of companies and organizations in various sectors.

 

Mark has spoken extensively on human rights, employment and active adjudication issues, and has taught on these issues at Osgoode Hall Law School and the Society of Ontario Adjudicators and Regulators. While in practice, Mark was regularly recognized on L’Expert as a leading practitioner in workplace human rights.
